The payment process when selling real estate usually works as follows:
The buyer does not transfer the purchase price directly to the seller, but only after all conditions in the purchase contract have been fulfilled.
The payment request is made by the notary.
The amount is usually transferred to a checking account specified by the seller.
Notary escrow account (trust account): In special cases, such as legal uncertainties or pending approvals, the money may first go into a notary escrow account.
Important: The notary ensures correct processing and protects both parties.
Yes, under certain conditions, the sale of real estate can be tax-free:
Owner-occupied property: If you lived in the property in the year of sale and the two previous calendar years, the profit from the sale is tax-free (§ 23 EStG).
Rented property: If a rented property is sold after the 10-year speculation period has passed, no speculation tax is due on the profit.
Tip: Observing the speculation period is especially important for investors.
When selling real estate, there is a duty to disclose essential defects:
Hidden defects such as mold, moisture, asbestos or structural damage must be disclosed to the buyer.
If a defect is deliberately concealed, this can lead to claims for damages or reversal of the purchase contract.
Minor visual signs of use (e.g. scratches on the floor or worn walls) do not need to be mentioned separately.
Whether and which taxes apply depends on the individual case:
Speculation tax: Due if you sell a property within ten years of purchase (applies to rented properties).
Trade tax: Only for commercial property sales, e.g. multiple sales per year or classified as a commercial seller.
Real estate transfer tax: Always paid by the buyer.
Foreign property: Additional tax obligations may arise depending on double taxation agreements.

Yes, when selling a property, a valid energy certificate is mandatory:
The energy certificate must be presented at the latest during the viewing (§ 80 GEG).
There are two types:
Consumption-based certificate: Based on actual energy consumption, more cost-effective.
Demand-based certificate: Based on a technical analysis of the building, more precise and often mandatory for older properties.
Tip: Have the certificate issued early to avoid delays in the sales process.

Unrealistic price expectations: A price that is too high deters buyers, one that is too low leads to losses.
Lack of preparation: Poor photos, no professional exposé, or missing documents delay the sale.
